While using secondhand-robot.com, called “site” in this document, you accept the following Terms of Use specifying the relationship between you and the site or his manager Robotique Concept.
Your full acceptance on Terms of Use, automatically and fully, is necessary to use the site
Robotique Concept keeps the right to modify at any moment the Terms of Use, without notice or compensation.
1. USE OF THE SITE
The site is available as is, free according to his disponibility and without any guaranty from Robotique Concept. Its use is made at your own risks under your responsability
Robotique Concept keeps the possibility, when it wants, to modify or stop temporaly or definitely all or a part of the site, without any explanation or compensation.
Under reserve of legal rules, Robotique Concept couls not be responsible of any direct or indirect commercial or financial loss, loss of datas, immaterial goods resulting of the dysfunction of the site and more generally of any event having a relation with the site or other site. Particularly, the responsability of Robotique Concept will not be involved in case of partial or total “hacking” of the site and problems that this “hacking” could create towards you or anyone.
In case of definitive close of the site, an explanation message will be prompted on the welcome page of the site for 15 days before the closing date of the site.
You accept not to give us the responsibility of the announces put by users or their intermediaries. As most of the announces come from other users, we do not guaranty the datas or explanations about description, safety, quality or other criterion about the described installations.
Robotique Concept keeps the right to close any user acount or take off any announce, without any explanation and without possible claim of the seller or the buyer.
Robotique Concept keeps the possibility to take off announces of robots not sold after 6 months or 1 year on the site.
2. HAVING AN ACCOUNT
To sell or buy, you have to get an account, which is free.
Robotique Concept could have to get some personal informations about you. Those informations are used by Robotique Concept and might be transmitted to other firms or people. If you do not agree with that, you can, according to the french law “informatique et liberté” n° 78-17 of the 6th January 1978, you can forbid it and you can too modify or get back those datas by writing it to Robotique Concept or by using the contact document available on the site.
Robotique Concept keeps the possibility to provide a good service, to put some “cookies” on your computer and to get them to ensure the management of the files that you open about the personnal services of your account.
You can parameter you «browser» to stop or refuse those cookies but the services of the site using an account will not be available for you.
When getting an account, the users recognise to have the right to represent their firm in the concerned commercial action, that they have the right to buy or sale the machines as representatives of their firm and that their firm has the right too.
3. RESPONSIBILITY OF ROBOTIQUE CONCEPT
Robotique Concept examine the offers concerning the robots for sale and transmit them to the buyer only if Robotique Concept consider that they are OK towards the technical and commercial criterions of its own. Then the buyer choose the offer which seems the best according to his own criterions : localisation, solvability, etc.
Robotique Concept negotiate the prices between the buyer and the seller and manager the commercial relationship by finding a compromise on buying conditions: prices, payment conditions, etc. Robotique Concept can be leaded to ask a bank guaranty to the buyer to secure the sell.
When both firms are OK on the whole conditions, they do themselves the sell with their own documents.
A copy of the invoice is asked to the seller by Robotique Concept to confirm and justify the commissioning of Robotique Concept..
Robotique Concept will not be considered as responsible of the failure of one of the 2 contractors who would not do as previous conditions and could lead to the nullity of the sell. All material or immaterial following loss will not be in charge of Robotique Concept.
4. RESPONSIBILITY OF USERS
When using or consulting the site, it is forbidden to behave in the wrong way as following:
The users have to respect their national rules or the international rules dealing with the use of Internet.
It is forbidden to use the files or the descriptions of the robots written in the data base of the site and more generally any visual or written information of the site without written right done before from Robotique Concept and limited in time.
The robots for sale have to belong to the sellers, apart in case of special commercial agreement with Robotique Concept.
The sellers accept to let them installations to sell be visited by Robotique Concept to check the transmitted datas.
They inform Robotique Concept of the sale by 48 hours
5. PRICES
Prices are exclusively written in Euros. The business is done in European money.
Prices are out of rates.
Prices given in the announces include the commissioning + the price of the seller.
The commissioning is calculated in the page before the selling. For special negotiated cases, Robotique Concept keeps the possibility to modify this commissioning.
Prices given in the announces does not include any service linked with the selling of the installation, specially dismounting, handling, transport, taxes or expenses due to the mounting, the modification of the installation or its start. Those expenses are in charge of the buyer by defect.
6. PAYMENT
The standard payment conditions are specified in the "selling" section of the site.
The deposit can be done by cheque or bank transfer for the selling in France and only by bank transfer abroad.
For the selling out of Europe, a "credit documentaire" will be done at delivery. The machines will have to be paid 100% before leaving France. Robotique Concept will have the possibility to install special actions to secure the payments.
7. GUARANTY OF THE ROBOTS
If no special guaranty is specified, the materials are sold as it without any guaranty neither from Robotique Concept neither from the seller. The buyer has to check the machine before buying and cannot stop the selling in case of problem at the start of the machines.
8. NULITY AND OPPOSITION
The fact that Robotique Concept does not ask for execution of any action of the Terms of Use does not mean that Robotique Concept will not ask later on. If a court had to stop any of one of those Terms of Use, the others would keep on being usable.
9. COUNTRY LAWS - CONFLICTS
The site has to be in conformity with French jurisdiction and in case of conflict the court will be those of Dijon, France.
